摘要: • There is a right to refuse treatment and this already exists in the legal doctrine of informed consent. The basic justification for overcoming incompetence patient. Incompetence also central consideration any constitutional treatment. theories are briefly presented their implementation different recent decisions considered. A distinction made between requirement proving incompetency appointing neutral party as arbiter incompetent patients. ruling that recognizes permits psychiatrists rather than arbiters make patients discussed model should be acceptable psychiatry.
