摘要: Abstract The purpose of this chapter is to survey the academic literature on economics litigation and synthesize its main themes. begins by introducing basic economic framework for studying out-of-court settlement. One set issues addressed positive (or descriptive) in nature. Under what conditions will someone decide file suit? What determines how much spent a lawsuit? When do cases settle out court? Important normative are also addressed. Are decisions made private parties interest society as whole? Next, surveys some more active areas literature. Topics include rules evidence, loser-pays rules, appeals, contingent fees attorneys, alternative dispute resolution, class actions, plea bargaining.
