Intellectual property rights on creativity and heritage: the case of the fashion industry

摘要: Recently, as different projects aiming to define and reinforce property rights in the fashion industry have been elaborated discussed, a lot of papers dedicated question this industry. Our paper considers problems from specific point view; it focuses on relation between creativity. If allow allocation majority standard industrial goods without any special difficulty, however, when they are applied creative goods, new arise. Then, for us, persistence low system IPRs does not mainly derive its efficiency but characteristics inputs that used production process. They constitute strong constraints defining, entitling, legitimating, enforcing, valuating exchanging rights. Thus, economic actors develop kinds strategic behaviour order obtain earnings can try protect copyrights, trademarks, assets, old assets (heritage), private or collective so on. The institutional industry—such models management, type ownership, size firms, … lead historical management through IPRs. Peculiarly, financial groups integrate into luxury industries currently implement move towards stronger model street puts an obstacle project.
