An illusion of understanding: how native and non-native speakers of English understand (and misunderstand) their Miranda rights

摘要: The purpose of the Miranda rights in USA is to ensure that suspects know their fundamental under law, yet even native speakers English do not always understand (Rogers, Rogstad, Gillard, Drogin, Blackwood and Shuman, 2010; Rogers, Steadham 2011). To evaluate understanding, Grisso (1998) developed Rights Comprehension Instruments (MRCI), normed with widely accepted legal community. by second language (L2) English, on other hand, inferred based L2 proficiency, but no studies date offer scientific basis for causal connections between proficiency understanding rights. present study was compare among (n = 82) advanced 183) determine whether standardised assessments can predict comprehension Our results show most our participants failed displayed significant disadvantages basic level processing comparison speakers. Furthermore, they were unaware failure: using linguistic resources at disposal these constructed alternative meanings created an illusion understanding.
