Medical non-disclosure and hypothetical consent

摘要: The difference between battery and negligence with regard to the effect of hypothetical consent its justification by different degrees which non-disclosure information doctor violates patient's autonomy is discussed. Four situations medical are examined show that informed should continue exclude liability in negligence, provided rather than patient bears legal burden proof as causation determined asking what particular claimant, not reasonable person would have done.
