Community development agreements in the mining industry: an emerging global phenomenon

摘要: Agreements between commercial developers and local communities are becoming more common in virtually all parts of the world, from inner city America to remote mining regions. The need for such “community development agreements” (CDAs) is especially acute mining, where environmental social costs often borne by while project benefits accrue national capitals global financial centres, leading conflict people miners. This article identifies forces behind recent spread CDAs industry, provides a sense some general trends nature impact CDAs. also raises key issues regarding that equally relevant other contexts. These include implications unequal bargaining relationships developers; equity distribution generated CDAs; enforceability implementation agreements.
