摘要: The purpose of this chapter is to analyze if and what extent the current legal framework in Germany enables adaptation rising sea levels. regulations examined mostly relate either flood protection or climate change adaptation. begins with a brief introduction Germany’s system, before moving on risk assessment funding. After exploring these general issues, chapter’s focus shifts towards different coastal strategies, starting dominating ‘protect’ strategy. First all, includes structures, primarily dikes that characterize mainland coast German North Sea. In context, role property rights regard expropriation. investigation then continues by addressing flood-resistant design insurance as examples an accommodation Legal instruments spatial land use planning limiting further development are subsequently explored. Afterwards, thesis addresses whether retreat strategy could be implemented under existing law, particularly regards rights. examination intersecting areas like nature conservation impact state liability for inadequate explored since also constrains action. As final step, evaluated suggestions improvement made.
