摘要: The idea that transnational dynamics challenge the regulatory capacity of state has hardly ever received as much attention in contemporary debates. Different voices denounce crisis and advocate establishment supranational institutions with legally coercive power. It is tempting to jump conclusion these are concerned same cluster problems. We think one should resist this temptation. Firstly, not all problems pointed out by advocates sovereignty kind structure. Some concern need limit power states, whereas others address almost opposite necessity support strengthen their problem-solving through forms international regulation. Secondly, corresponding solutions different. In particular, although they may imply institutions, such be global. creation a full-blown global rule criminal law, for instance, would raise serious concerns despotism cultural imperialism, we therefore make case regional context-sensitive case.
