Troubles with Transposition? Explaining Trends in Member-State Notification and the Delayed Transposition of EU Directives

摘要: EC directives must be transposed into the national legal order of member states within a specified deadline. Although are obliged to notify their transposition measures, they often fail comply with these deadlines. Distinguishing between domestic and EU-related factors, this study examines failure delay from 1986 2002. Notification is found more likely when there conflict during EU legislative process. National patterns timeliness shown vary significantly, higher levels complexity increased use parliamentary legislation, as well federalist pluralist structures, contribute delayed compliance.
