摘要: Offenders with disabilities have a vulnerable status in prison. Due to inadequate facilities and lack of care available address their special needs prison, health may even deteriorate from imprisonment. The prisons carry out the sentences decided by courts. It is therefore interest examine how courts mete punishment when defendant has disability. How are offenders ‘seen’ perceived penal law courts? Does disability matter court metes sentence, if so, what way? Should as mitigating circumstance? should be dealt criminal justice system? These questions addressed this article.
