摘要: The U.S. Department of Education recently amended the regulations implementing Title IX 1972 Amendments, which is federal statute prohibiting discrimination on basis sex. new provide greater flexibility for school districts to offer single-sex public elementary and secondary education. They embrace recent growth education in United States, but some question their constitutionality. This Note explores how Supreme Court should rule a challenge brought against under Equal Protection Clause. It introduces IX, regulations, relevant Clause jurisprudence, it presents an argument upholding regulations' then proceeds by rejecting previously proposed analogy "separate equal" doctrine segregation race Instead, favors athletic field, where sex has thrived suggesting that programs promoted may be able withstand judicial scrutiny.
