THE PASTERNAK CASE AND AMERICAN GENDER EQUITY POLICY: IMPLICATIONS FOR CANADIAN HIGH SCHOOL ATHLETICS

摘要: In 2004 twin sisters Amy and Jesse Pasternak competed for the prospect of playing high school hockey, vying boys‟ team rather than girls‟. The sisters‟ opportunities were negated by Manitoba High School Athletic Association (MHSAA). This paper examines 2006 decision Human Rights Commission a 2008 judgment provincial Court Queen‟s Bench regarding an application judicial review. We argue that these decisions imply Canadian governance bodies should study gender equity policies surrounding similar challenges in United States. ultimately has implications future such circumstances.
