摘要: This paper explores the idea of ‘legal mobilisation’, focusing particularly on use individual employment rights by unions to pressurise employers and galvanise support amongst members for action key workplace issues. Literature from north America suggests that law can provide inspirational effects, crystallising a sense injustice highlighting availability redress, radiating where positive outcomes are diffused with view changing employer behaviour or mobilising broader groups workers. Data two critical case studies in UK, however, highlight tensions strategies this kind. Minimal complex statutory provision makes cumbersome instrument organising strategies. Legal mobilisation is likely remain as pragmatic tactic specific circumstances, but more systematic adoption seems unlikely British context.
