摘要: The Mental Capacity Act received Royal Assent on 7 April 2005, and it will be implemented in 2007. defines when someone lacks capacity supports people with limited decision-making ability to make as many decisions possible for themselves. lays down rules substitute decision making. Someone taking behalf of the person lacking must act best interests concerned choose options least restrictive his or her rights freedoms. Decision making allowed without any formal procedure unless specific provisions apply, such a written advance decision, lasting powers attorney by court protection.
