Empirical Analysis of Intellectual Property Risks in Software Outsourcing

摘要: We address the issue of intellectual property (IP) rights in onshore and offshore software development outsourcing. IP assets are generally intangible nature easily misappropriated by contracting parties. The paper examines two protection mechanisms employed firms: rights-sharing arrangements restrictive covenants using data from 153 contracts across 14 countries we show how related to customization, modularity, pricing scheme, strength overall legal environment vendor countries.
