摘要: In the legal scholarship, ‘new governance’ mode of governance advances an administrative arrangement where decision-making is shared amongst a range actors, both public and private. The flexible, responsive, collaborative orientation intended to counter ill effects coercive, top-down, state-centric, command-and-control approach governance. Critics contend new framework can displace interests local communities, disempower individuals, dislodge basic human rights. U.S. military has adopted such adaptive in its own structure, which this article referred as: “mentality.” This mentality was employed U.S.’s post-conflict reconstruction efforts Iraq—efforts that were plagued by waste, inefficiency, corruption.
