An experimental investigation of multi-defendant bargaining in ‘joint and several’ and proportionate liability regimes

摘要: Abstract This study uses experimental methods to assess how different legal regimes affect the frequency and amounts of settlements in a three person setting (one plaintiff two defendants). The four investigated differ along dimensions: (1) allocation liability, either ‘joint several’ or proportionate (2) liability mappings, unconditional conditional mappings. We find that lowest settlement frequencies occur with joint several rules. In addition, rules have most adverse effects on defendants' wealth.
